A Naivasha court has issued summons to State House Comptroller Lawrence Lenayapa in a case facing Nandi Hills MP Alfred Keter and his nominated counterpart Sonia Birdi.

Senior Assistant Director of Public Prosecutions Njagi Nderitu had applied to have summons issued to Mr Lenayapa and to be served by the Inspector-General of Police.

The court granted the application and issued summons during a hearing of the case on Tuesday.

The prosecutor had made a similar application during a hearing on September 3 last year.

“It has proved difficult to issue summons directly to the State House comptroller owing to the nature of his office,” noted the prosecutor.

The charges against Mr Keter read that on January 24, 2015 at the Gilgil weighbridge he repeatedly shouted and uttered abusive words that included unprintable epithets demanding the release of an impounded vehicle.

He also faced a second count stating that jointly with Ms Birdi he incited George Omboro Obiero to go against the provisions of the Kenya Roads Act by releasing a truck without an exemption permit.


Testifying, SGS Kenya Limited Assistant Weighbridge Manager Mukhono Wafula told the court that he was not on duty when the altercation with the MPs took place.

He said he inspected the impounded vehicle in the presence of the driver and two other people whose details he did not take.

“I finished the inspection at 10:15 hours when the vehicle was weighed and rubber-stamped the weighbridge ticket NO KGN15003426/1 and appended my signature at the time,” said Mr Wafula.

He then went back to the office and proceeded with other duties until the station manager was able to print the exemption permit.

He further told the court that the vehicle was later released.

For his part, Police Constable Isaac Mukonambi told the court that he recorded the incident using his mobile phone for his personal use before the video went viral on social media.

“Because I was dealing with high-profile personalities I decided to record the proceedings for my social media use,” he said.

The police constable said he later gave the recordings to different agencies including the traffic department.

The two MPs are facing similar charges of incitement and intimidation, but the Nandi lawmaker also faces another charge of creating a disturbance.

The case was adjourned until November 30, when the hearing resumes.
