NASA supporters can now rest easy, for a while, after a judge temporarily lifted the ban on demonstrations.
High Court judge Chacha Mwita also barred the state from arresting and prosecuting NASA secretariat head Norman Magaya over protests.
The judge also directed the parties in the matter to be served with suit papers and set the matter for hearing on 25.
His orders arose out of an application by Magaya.
He was challenging directives that he be held personally liable if protesters destroy public property.
Magaya has sued acting Interior CS Fred Matiang’i, IG Joseph Boinnet and DPP Keriako Tobiko.
He argues that if the court does not intervene, he stands to suffer irreparable damage as his rights will be violated.
Magaya also says protesters have a right to take part in peaceful demonstrations as provided for in the Constitution.
He has accused police of engaging in discriminatory killings in opposition strongholds.
